If I call ESPN the 'Evil Empire' is that hate speech? Who decides?
Just watching two ESPN time fillers "High Noon" tell me that the Tomahawk Chop is hate speech and the Atlanta Braves should kick fans out for doing it. There is a huge difference between poor taste and hate speech? When they are done outlawing the Chop then they will make them change their names?
Does hate speech have to have some specific target not a general hated person. Do I actually have to hate instead of you being insulted? Seems to me intent should matter.
I'll just write these guys off as talking heads like I did when ESPN was going after PSU. Boy a lot of that was hate speech?
Now I will not fly a rebel flag, do the chop (I hate Atlanta), or a few other things I know may offend people but that doesn't mean this stuff is anywhere near hate speech.
Is it a strategy to empower yourself by being insulted? I don't know any Indians but I've been out west, if they want to be insulted it should be about the poverty the government put them in by putting them on a reservation where nothing can live. I doubt they care about a Tomahawk Chop!

There are several indian reservations that have high school teams nicknamed the Redskins. That tells you how offensive it really is, because they are using it with zero issue.

The tomahawk chop is offensive???? Funny, Florida State does it and they have the blessing of the Seminole nation of Florida to do it. All it does is simulate a warrior chopping with a weapon... which is no different from Texas Tech doing their "Guns up" thing shooting into the air. Same damn thing.
Objectively speaking... If there is one thing that is probably more offensive that anything in sports it's the Leprechaun at Notre Dame. "Hey look... we are the Fighting Irish and our mascot makes fun of Irish by making them look like they lost their lucky charms". However, Irish people have emotional intelligence... so no one gets offended by it. LMAO
